The prevailing sentiment about the new tax law seems to be that most same sex couples will "benefit or break even". I am curious to find out how it turns out in reality.

It didn't work out well for us. We paid $1,252 more in Federal taxes under the new law, compared to if we had been able to file 'married/joint'. We paid $1,628 more in Fed taxes than we would have under the tax law applied to us last year (two, separate, single returns).

It seems to me that we are given one option--to be subjected to the rules that apply to "married filing separately". This is an option available to heterosexual married couples, but is rarely used, presumably because it is rarely beneficial to do so.

Other nasty factors were:
-- the "surprise factor", precluding any attempts of tax planning for 2010.
--spending a long time with Pub 555 trying to figure out our separate and community property and how it affects every bit of income.
--triple tax preparation fees.

It's hard not to be bitter.

I'm interesting in setting up a living trust. Is there someone in your office available to discuss this/cost/and setting up and an appointment.

Thanks in advance,
Reggie Johnson

Turbotax failed to live up to their promise to support this change. While the site promised an update on 3/10, the 3/10 update failed to materialize any help for couples in same sex marriage or RDPs
