Even as hope grows for legal equality for same-sex couples, the answers to these questions aren’t always clear. That’s why it’s important that the LGBT couples protect their families by understanding their rights and benefits under Medicare and Medi-Cal and documenting their future health care wishes.
Unless spouses and partners know their rights and have their wishes are in writing, a parent or sibling can question whether who has the right to be their relative’s health care decision-maker or even visit him or her in the hospital.
LGBT couples could also find their rights challenged if they travel outside California, especially to a state that has passed a Defense of Marriage Act (DOMA). Even in California, without clear documentation, the State could end up making decisions because of lack of documentation.
