Probate
Probate is a court-supervised process that transfers legal title to someone's assets after that person dies. Many steps and technical rules are involved in probating an estate, and multiple court appearances usually are required. Attorney fees and other probate fees are set by statute.
At death, a person's estate is subject to probate if arrangements have not been made to transfer assets through a living trust or via beneficiary designations or survivorship rights. Assets transferred pursuant to the terms of a will generally go through the probate process. If assets are located in more than one state, multiple probates may be required.
